These Terms of Service (“Terms”) govern access to and use of the website and client area located at mytscupid.com (the “Site”), and any related content, downloads, software, plugins, PWA apps, license keys, updates, support, and services (collectively, the “Services”).

2) Acceptance of these Terms
By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
3) Eligibility (18+)
The Site and Services are intended for individuals 18 years or older. By using the Site or purchasing a product/service, you confirm that you are at least 18. We do not knowingly provide Services to minors.
4) Other policies and order of precedence
These Terms incorporate by reference:
- our Privacy Policy; and
- our Refund Policy (available at /refund_returns/).
If there is any conflict regarding refunds, cancellations, returns, or withdrawal rights, the Refund Policy controls for those topics. Nothing in these Terms limits rights that cannot be excluded under applicable law.
5) Accounts (Client Area)
If you create a client area account, you agree to:
- provide accurate information and keep it up to date;
- keep your login credentials confidential; and
- notify us promptly of any unauthorized use.
You are responsible for activity under your account, except where prohibited by applicable law.
6) Purchases, digital delivery, and access
When you purchase a digital product or service, we will provide access (for example: downloads, license keys, dashboards, or client area access) according to the product description at the time of purchase.
We may update or change the way we deliver digital products (for example: new download locations or updated installation steps) as long as the core purchased functionality remains materially the same.
7) Payments and payment processors
We use third-party payment providers to process payments. We do not store full payment card details on our servers.
- If a payment is flagged for risk review or fraud prevention checks, delivery/access may be delayed or withheld until verification is completed.
- If you have billing questions, contact us first using the details in Section 1. We will assist you and, when necessary, coordinate with the payment provider.
8) Refunds and EU/EEA/UK right of withdrawal (summary)
8.1 Refunds
Refunds are handled under our Refund Policy (see refund-policy). Please read it carefully before purchasing.
8.2 Right of withdrawal (EU consumer law)
If you are a consumer in the EU/EEA/UK and you purchase online, you generally have a 14-day right of withdrawal for distance contracts, subject to exceptions.
For digital content/digital services, the right of withdrawal can end once performance begins if you:
- request immediate performance/delivery; and
- acknowledge that you lose your right of withdrawal once performance begins.
Where applicable, we may ask for this consent/acknowledgement during checkout before granting access.
9) Support
We may provide support as described on the Site or in your purchase documentation. Support scope may exclude:
- custom development;
- third-party server or plugin conflicts outside reasonable troubleshooting; and
- issues caused by unsupported modifications.
When troubleshooting, we may request reasonable technical details (logs, screenshots, versions). If access is necessary, we may request temporary access via a secure method (e.g., staging site, temporary admin user). You agree not to withhold necessary information required to reproduce a reported defect.
10) License and permitted use (digital products)
Unless otherwise stated, purchases grant you a non-exclusive, non-transferable license to use the digital product for your internal business purposes or personal use, as described at purchase time.
You may not:
- resell, sublicense, share, or distribute the product, license keys, or downloads;
- remove copyright notices or branding (unless explicitly permitted); or
- reverse engineer or bypass technical restrictions, except where mandatory law allows it.
11) User content (if applicable)
If the Site allows you to submit content (e.g., comments, tickets, uploads), you represent that you have the necessary rights to submit it and that it does not violate the rules below.
You grant 2Date Media a worldwide, royalty-free, non-exclusive license to use, reproduce, and display such content solely to operate, support, and improve the Services (and to respond to you).
12) Acceptable use
You agree not to:
- use the Site for unlawful activity;
- upload malware, exploit vulnerabilities, or interfere with the Site;
- send spam or deceptive communications;
- infringe intellectual property rights; or
- harass, threaten, or defame others.
We may suspend or terminate access for violations.
13) Intellectual property
The Site and Services (including software, branding, and content) are owned by 2Date Media or its licensors and are protected by intellectual property laws. These Terms do not transfer ownership to you.
14) Third-party links and services
The Site may link to third-party sites or integrate third-party services. We are not responsible for third-party content, policies, or practices.
15) Termination and suspension
We may suspend or terminate your access to the Site or Services:
- for breach of these Terms;
- to comply with law or enforce security; or
- to prevent fraud or abuse.
Where required by law, we will provide notice and an opportunity to cure. Refund questions are governed by the Refund Policy and applicable law.
16) Disclaimers
The Site and Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties such as merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
17) Limitation of liability
To the maximum extent permitted by law:
- 2Date Media will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.
- Our total liability for claims relating to the Services will not exceed the amount you paid to 2Date Media for the affected product/service in the 6 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including certain consumer rights).
18) Indemnification (business users)
If you use the Services on behalf of a business, you agree to indemnify and hold harmless 2Date Media from claims arising out of your misuse of the Services or violation of these Terms.
19) Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on the Site with a revised “Last updated” date. Continued use after changes means you accept the updated Terms.
20) Governing law and disputes
These Terms are governed by the laws of the Netherlands, excluding its conflict of law rules. If you are a consumer, you may also benefit from mandatory protections under the laws of your country of residence.
